    Abstract [en]

    The series of recent crises (EURO, refugees, backsliding, Brexit) challenge the self-portrayal of the European Union (EU) as a community of shared values. Against this backdrop, we analyse European Values Study data from 1990 till 2020 to assess the level and change in publics’ acceptance of the EU’s officially propagated values: personal freedom, individual autonomy, social solidarity, ethnic tolerance, civic honesty, gender equality and liberal democracy. We find that EU publics support these values strongly and increasingly over time. The EU-member publics are also remarkably distinct culturally from Eastern European non-EU-nations, especially concerning individual freedoms and gender equality. Simultaneously, however, member nations internalize EU-values at different speeds–alongside traditional religious fault lines that continue to differentiate Europe–in the following order from fastest to slowest: (1) Protestant, (2) Catholic, (3) Ex-communist and (4) Orthodox countries. In conclusion, the EU writ large evolves into a distinct value-sharing community at different speeds.

    Runtom i världen sker många väpnade konflikter vilket leder till att folk migrerar och söker asyl i ett annat land för skydd. En undersökning av 4 kap. 1 och 2 §§ samt 2b, 2c §§ Utlänningslagen (2005:716) kommer att göras i den här uppsatsen, för att få en djupare förståelse för hur dessa lagrum tillämpas och hur högre instanser tolkar lagrummen när de fattar ett beslut. I uppsatsen kommer flera rekvisit att behandlas för att tydligare kunna förstå innebörden av lagrummen som undersöks. Syftet är att undersöka när anses en utlänning som flykting enligt utlänningslagen, vilka grunder för förföljelse finns i 4 kap. 1§ UtlL och vad innebär de. När anses en utlänning som skyddsbehövande enligt utlänningslagen och när utesluts en utlänning från att anses som flykting eller skyddsbehövande enligt utlänningslagen. Undersökningen kommer att göras utifrån den rättsdogmatiska metoden och det innebär att undersöka vad olika rättskällor som finns i vårt samhälle ger uttryck för, samt undersöka bakgrunden till att lagen finns, och fastställa gällande rätt. Avslutningsvis avslutas undersökningen genom att besvara syftet samt frågeställningen, kortfattat om slutsatsen är att för att en utlänning ska anses som flykting ska hen känna välgrundad fruktan för förföljelse. Utan en välgrundad fruktan, kan man inte konstatera att en person är flykting. Grunderna som benämns i lagen och som har undersökts i detta arbete är ras, nationalitet, religiös uppfattning, politisk uppfattning, kön, sexuell läggning eller tillhörighet till en viss samhällsgrupp, vad de olika grunderna innebär framgår tydligt i den rättsliga analysen. För att en person ska anses som skyddsbehövande ska det finnas en grundad anledning att anta att personen löper allvarlig risk för att skadas av det landets myndigheter som hen kommer ifrån eller löper risk för att bli skadad av enskilda och att myndigheterna inte kan skydda hen från det. En utlänning utesluts från flyktingskap om det finns synnerlig anledning att anta att hen har gjort sig skyldig till brott mot freden, brott mot mänskligheten, eller grovt icke politiskt brott. Uteslutning av skyddsbehov om personen anses vara en allvarlig fara för allmän ordning och säkerhet i Sverige, eller har begått ett av de brott som framgår av 4 kap 2b§ UtlL.

    Abstract [sv]

    Huvudsyftet med detta rättsvetenskapliga examensarbete, vilket behandlar statsrätt i allmänhet och konstitutionell rätt i synnerhet, var att öka förståelsen för judikaliseringsprocessen med Lagrådet som fokus. Studien bygger på rättsdogmatisk metod: där lagar, förarbeten, praxis och doktrin legat till grund för den diskussion som avslutar uppsatsen. Studien har bland annat undersökt vad Lagrådet har för roll och funktion i lagstiftningsarbetet och hur denna har förändrats över tid. Lagrådets granskning var inledningsvis obligatorisk, men ersattes under 1970-talet med en fakultativ granskning och stadfästas som sådan i den nya regeringsformen från 1974. Författningen sanktionerar suverän statsmakt och implicerar ett avsteg från den rättssäkerhet som kommer utav autonom judiciell makt och maktdelning. Då juristernas betydelse har ökat, i och med judikaliseringen, har också behovet av kontrollorgan – såsom Lagrådet – ökat. Som en följd härav bör vi återgå till den obligatoriska lagrådsgranskningen. Detta uppnås genom att den fakultativa bör-regeln slopas och ersätts med en obligatorisk ska-regel. Genom detta kan Lagrådets särskilda kompetens till fullo utnyttjas, företrädesvis i konstitutionella frågor.

    Ett barn ska växa upp i ett hem där barnet tillförsäkras en god uppväxtmiljö, trygghet och närhet till sina föräldrar. Ändå finns det barn i dagens samhälle som inte får denna trygghet och far illa i det egna hemmet. I sådana situationer är det socialnämnden som ingriper för att skydda barnet och ett beslut om tvångsvård kan bli aktuellt med stöd av 2 § lag (1990:52) om särskilda bestämmelser om vård av unga, LVU. Uppsatsen behandlar huvudsakligen rekvisitet brister i omsorgen och principen om barnets bästa. Rekvisitet brister i omsorgen inrymmer en rad olika situationer där barn far illa på grund av föräldrarnas bristande omsorgsförmåga. Bristerna måste innebära en påtaglig risk för att den unges hälsa och utveckling skadas och det får därmed inte handla om avlägsna risker eller risker av mindre omfattning. Barnets bästa ska vara avgörande vid varje beslut om tvångsvård av barn enligt LVU. Bedömning av riskerna vid brister i omsorgen sker utifrån omständigheterna i varje enskilt fall och vad som anses vara barnet bästa ska vara avgörande vid beslut om tvångsvård på grund av brister i omsorgen. Vid fastställande av barnets bästa bedöms barnets behov och intressen, samt om barnets behov kan tillgodoses av barnets vårdnadshavare. Både rekvisitet brister i omsorgen och principen om barnets bästa är brett utformade, vilket i praktiken försvårar bedömningen och kan ge upphov till olika tolkningar vid dess tillämpning.

    The HCR-20 and the PCL:SV were used in a prospective study of 41 long-term sentenced offenders in two correctional, maximum-security institutions. The aim was to test the validity of these instruments in the prediction of institutional violence. All assessments were made by a comprehensive examination of the offenders’ files, completed with clinical interviews ranging from 1 to 3 hours. The mean follow-up time was 8 months. Our results show high predictive validity for the HCR-20’s clinical and risk management items, but for almost none of its historical items. The results suggest that violence inside correctional institutions can be predicted with a certain degree of validity by using the HCR-20 and the PCL:SV, even within a selective ‘high-risk’ group of offenders such as that under study here.

    Abstract [en]

    Purpose. This study focused on whether institutional violence in a maximum-security correctional institution could be prevented using comprehensive risk assessments followed by adequate risk management. And, could this be shown by a decrease in risk factors for violence according to the HCR-20 Risk Assessment Scheme in the study group? Methods. Offenders with a history of violent criminality were subject to real-life assessments using the HCR-20 Risk Assessment Scheme. The assessments were followed by discussions with members of staff, in which risk management strategies were designed. Thus, the members of staff were fully aware of every inmate's personality characteristics (e.g. psychiatric diagnoses), what risk factors for violence they displayed, and how best to manage those risk factors. With the aim of evaluating the possible effects of our interventions, approximately one third of the study group was reassessed after a mean of 12 months. Results. The follow-up showed no significant decrease in important risk factors for violence in the study group. However, the number of violent incidents showed a remarkable decrease during the study period. Conclusions. Not being able to reduce important risk factors for violence does not necessarily mean that one cannot decrease the risk for, or the incidence of, violence. This study indicates that proper and adequate risk management, using the best protective factors available, can reduce violence even though important risk factors cannot be decreased. The study also supports the theoretical assumption that changes in risk factors are more possible in some populations (e.g. general psychiatric) than in others (e.g. correctional) depending on the nature of the study group and the risk factors that are at hand (e.g. dynamic vs. static). This seems to be important to bear in mind when performing evaluation research using risk assessment instruments.

    BACKGROUND: In Sweden 20 000 cases of assault against women are reported to the police every year. METHOD: All data on the perpetrators of spousal homicide in Sweden between 1990 and 1999 were investigated (n = 164). A control group of all other perpetrators of homicide in Sweden during the same period, i.e. cases of homicide not committed in the context of spouse violence (n = 690) was used. All verdicts, as well as all material in the police investigations, including interviews with all of the police investigators, were analysed. Copies of police examinations of the suspects, and forensic reports from the autopsies, were also examined. Data on all registered criminality were collected from the National Police Register, and in cases where the perpetrators had been subject to forensic psychiatric examinations, those reports were obtained from the Swedish National Board of Forensic Medicine. In addition, the Psychopathy Checklist: Screening Version scores were rated from the forensic psychiatric examinations. RESULTS: There was a four times higher suicide rate among the spousal homicide perpetrators (24%, n = 40) compared with the perpetrators in the control-group (6%, n = 39, chi-squared = 55,42 df = 1, p < 0.001). Consequently, suicidal ideation must be considered as an important risk factor for spousal homicide. In 79% of the cases the spousal homicide perpetrators were subject to forensic psychiatric examinations. All except 5% were diagnosed with at least one psychiatric diagnosis, and 34% were sentenced to forensic psychiatric treatment. If it is assumed that the psychiatric morbidity was high in the 24% of the perpetrators who committed suicide, then 80% of all perpetrators of spouse homicide during the study period can be characterized as mentally disordered. 'Psychopathic' perpetrators, who generally are over-represented in most violent criminality, were comparatively uncommon. Only seven (4%) in the study group met the diagnostic criteria for psychopathy as measured with the PCL:SV. DISCUSSION: The group of spouse killers studied here fits the dysphoric/borderline group of spouse assaulters. This is a group that may benefit from treatment. Perhaps police officers could help identify this kind of spouse assaulter before a fatality occurs.

    Abstract [en]

    The purpose of this legal dogmatic Bachelor Thesis is to define the legal definition of “a rescue service” and illustrate the division of responsibilities between national authorities and the municipalities with regards to the execution of emergency response operations.

    “A rescue service” means the emergency response actions that national and municipal authorities are legally obliged to provide to prevent or minimise injury to people and damage to property or the environment when emergencies occur or seem imminent. In the following cases a national authority is responsible for providing the requisite rescue service:

    1. Search and rescue (air) – the Swedish Civil Aviation Authority is the responsible authority;

    2. Search and rescue (maritime) the Swedish Maritime Administration is the responsible authority;

    3. Maritime environmental protection – the Swedish Coast Guard is the responsible authority;

    4. Mountain rescue service, – the police services in the four mountainous counties are the responsible authorities;

    5. General missing persons searches – the regional police are the responsible authority; and finally

    6. Emergency preparedness for nuclear energy incidents – the relevant county administrative board is the responsible authority.

    The municipalities are responsible themselves or in co-operation with others for all other rescue services required within the municipality’s boundaries.

    Abstract [en]

    In the 1960s environmental issues became analysed ina global context. 1992 sustainable development wasmade the overall policy. 2010 the biosphere is in a worsestate than in the 1960s, and the world human populationis higher than ever. For sustainability, human behaviourmust be kept within biospherical carrying capacity. Thispresents enormous social and human scientific challenges.However, main social scientific schools generallyoverlook what basically makes democratic systems tick,namely Rule of Law. Most social scientific input hasbeen hampered by pre-environmental sectoral paradigmsmissing the holistic prerequisites. Modernenvironmental law methodology has on the other handanalysed old law and developed theory for sustainablelaw capable of i.a. handling non-linearity, complexityand what makes societies tick – Rule of Law. Thanksto this, some of what other social sciences have broughtforward can be reinterpreted for inclusion in an adequatesustainability theory, while much of the rest canbe explained as ineffective.This paper brings this into broader environmentalscience. It will (1) rely upon the still degrading biosphereand that no country has so far established effectivecontrol for sustainability; (2) explain why such controlcannot be achieved in a democracy without recognisingthe Rule of Law and adapting the law to sustainability;(3) explain why mainstream social and human sciencesyet have not contributed more effectively; (4) presenta fundamental theoretical holistic structure essentialfor social environmental science, and (5) based on thisdemonstrate why it is impossible to solve the globalunsustainability problems without full understandingof the Rule of Law.
